Child Safety

Plainly (operated by Fernandez Software LLC) is an adult dating platform exclusively intended for users who are 18 years of age or older. We maintain a zero-tolerance policy against child sexual exploitation and abuse, and we are committed to providing a safe environment. This page outlines our Child Safety Standards and our formal Protocols for Law Enforcement.

1. Underage Prevention and Age Verification

Strict 18+ Requirement: Individuals under the age of 18 are strictly prohibited from creating an account, accessing, or using Plainly on iOS, Android, or Web.
Screening and Verification: We implement multiple mechanisms to prevent underage access, including age declaration during registration, automated signals, proactive profile review, and prompt investigation of user reports. Any account suspected or identified as belonging to an underage user is immediately banned and permanently ejected.

2. Zero-Tolerance for Child Sexual Abuse Material (CSAM)

We have a strict zero-tolerance policy regarding Child Sexual Abuse Material (CSAM) and Child Sexual Exploitation and Abuse (CSAE). We strictly prohibit any depiction, facilitation, discussion, solicitation, or sharing of sexually explicit content involving minors.
Any user attempting to upload, share, or promote CSAM/CSAE will face immediate and permanent account termination, immediate data preservation, and reporting to legal authorities and the National Center for Missing & Exploited Children (NCMEC).

3. Mandatory NCMEC Reporting

In compliance with United States federal law (18 U.S.C. § 2258A), Plainly promptly reports all apparent instances of CSAM, CSAE, and related child exploitation to the National Center for Missing & Exploited Children (NCMEC) via the CyberTipline.
NCMEC coordinates with domestic and international law enforcement agencies to investigate and prosecute offenses involving child exploitation.

4. Protocols and Guidelines for Law Enforcement

Plainly cooperates with authorized federal, state, and local law enforcement agencies in official criminal investigations, while safeguarding user privacy in accordance with the Electronic Communications Privacy Act (ECPA), 18 U.S.C. §§ 2701–2712, the Fourth Amendment, and other applicable laws.

A. Legal Process Requirements for User Data

•
Subpoena: A valid grand jury, trial, or administrative subpoena is required under 18 U.S.C. § 2703(c)(2) to compel disclosure of basic subscriber records (such as name, registered email, phone number, account creation date, recent IP logs, and login timestamps).
•
Court Order: A court order issued under 18 U.S.C. § 2703(d) (or state equivalent) is required to compel disclosure of non-content transactional records, connection logs, or extended account metadata.
•
Search Warrant: A search warrant issued upon a finding of probable cause under the Fourth Amendment or 18 U.S.C. § 2703(c)(1)(A) by a court of competent jurisdiction is required to disclose stored communication content (such as private messages, photos, videos, or audio communications).

B. Emergency Disclosure Requests (Exigent Circumstances)

Pursuant to 18 U.S.C. § 2702(b)(8) and § 2702(c)(4), Plainly may disclose records and communications to law enforcement without a subpoena or warrant when we have a good-faith belief that an emergency involving imminent danger of death, serious physical injury, kidnapping, or child exploitation requires immediate disclosure without delay.
Emergency requests must be submitted by verified law enforcement officials and must contain:
•
A detailed description of the emergency and why there is imminent risk of death or serious physical injury;
•
The specific account identifiers (registered email, phone number, User ID, or profile URL);
•
The specific, narrowly tailored information required to avert the imminent emergency;
•
The requesting officer’s full name, badge/ID number, rank, agency, and direct phone number.

C. Data Preservation Requests

In accordance with 18 U.S.C. § 2703(f), law enforcement may request that Plainly preserve account records pending receipt of formal legal process. Upon receiving a formal written preservation request on official agency letterhead, we will preserve relevant account records for 90 days (and an additional 90-day extension upon receipt of a written renewal request).

D. Submission Guidelines for Law Enforcement

• All requests must be submitted in writing on official department letterhead and signed by the requesting official.
• Requests must be transmitted from an official government email domain (e.g., @agency.gov or official police department domain). Inquiries from commercial webmail accounts (such as Gmail, Yahoo, etc.) will not be processed without independent verification.
• Clearly identify the subject account with specific details (registered email address, phone number, User ID, or profile link).
